Privacy Policy

The website https://reface.fund/ on the Internet (the "Site") is managed by the Charitable Organization “Charitable foundation “Reface Fund”, identification code of legal entity 44787350, having its registered office at: 9 (let. A) Kontraktova Square, Kyiv, 04070 (the "Organisation").

This Privacy Policy (the "Policy") establishes the procedure of personal data processing, categories of personal data collected, purposes of such personal data usage, procedure for the interaction of the Organisation with third parties, security measures to protect personal data, conditions of access to personal data as well as contact information for the Site user (the “User”) about getting access, making changes, blocking or deleting their personal data and addressing any questions that may arise regarding the personal data protection by the Organisation.

In accordance with the Law of Ukraine "On Personal Data Protection" you, as the User, consciously and voluntarily provide the Organisation a consent to the automated processing of your personal data and to the processing without automated decision-making (including, but not limited to, the collection, accumulation, storage and use) in the manner prescribed by this Policy.


1. Collection and use of personal data

1.1. The owner and processor of the User’s personal data is the Organisation. When using services of the Site, the Organisation may process the following User's personal data:

(a) data provided when filling out the payment form (e.g., e-mail address); and

(b) cookies (browser type and version, operating system, location information, visited pages of the Site, age, gender etc.).

1.2. The Organisation collects only those personal data (e.g., e-mail address,), which are knowingly and voluntarily provided by you when using the Site, that shall be considered as a consent for personal data processing in accordance with the purpose of its processing set forth in this Policy.

1.3. The Organisation collects and processes personal data based on the consent provided by the Users who are over 18 (eighteen) years of age.

1.4. When making payments on the Site, the User's payment data is collected and processed by the payment system, the functionality of which is implemented on the Site. The Organisation does not have access to, collect or process such data of the Donor (as defined in the Public Offer for a voluntary charitable donation available here).

1.5. The Organisation is limited to the collection of minimum amount of data necessary exclusively for the purposes defined in Section 3 hereof.

1.6. The Organisation does not collect data for the processing of which special requirements are established by the applicable law, namely: information about racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, criminal convictions for committing a crime, as well as data related to health, sexual life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine “On Personal Data Protection”).

1.7. The Organisation collects data on the Site’s visits statistic. The information may contain information about the connection, traffic, the User's browser, as well as about the date, time, duration of work on the Internet and being on the Site.


2. Processing of personal data

2.1. Processing and storage of provided personal data is performed in data centres, where equipment, which ensures functioning of the Site services, is located. The provided personal data is processed and can be stored in the table of personal data database separately from the Site’s database.

3. Purposes of processing of personal data

3.1. Your personal data is processed for the following purposes:

(a) to ensure the transfer of the voluntary Charitable Donations, in accordance with the Public Offer;

(b) o provide reports on the use of the Charitable Donations by the Organisation;

(c) to provide access to the Site;

(d) to analyse and maintain statistic;

(c) to track cases of violations of the provisions of this Policy and/or the Public Offer;

(f) to follow the requirements of applicable laws.


4. Term of personal data storage

Personal data is stored no longer than it is necessary in accordance with the purposes of its processing.


5. Usage of cookies


5.1. Cookie is a text file or files containing a small amount of information which is requested by the web browser and stored on the User's device (the “cookie”). Such devices may include, but are not limited to, a computer, mobile phone or other device used by the User to access the Site.

5.2. When the User re-visits the Site, the cookie data updates. In most cases, the web browser by default allows automatic storage of cookie files on the User’s device. Disabling the cookie files can lead to reduced access to the published materials and/or incomplete functioning of the Site.

5.3. To make your stay on the Site as convenient as possible, the Organisation needs to use cookies to analyse the behaviour and interests of the User. Such analysis will help the Organisation to improve the experience of interaction with the Site, as well as to identify the most convenient interface and the navigation.

5.4. The Organisation uses the following categories of cookies:

(a) Strictly necessary cookies – they are necessary for navigation of the User on the Site and when using some services of the Site, for example, for access to protected pages, registration and authorisation, performing searches on the Site. They also remember the user's previous actions by going to the previous page in the same session.

(b) Performance cookies – they consolidate information about how the Site is used. This data is stored on the User's device between web browser sessions. Examples of such data include, but are not limited to, the following metrics: time spent on the Site, most frequently visited pages, understanding which sections and services of the Site were of most interest to the User, how effective a particular advertising and/or marketing campaign is etc.

(c) Functional cookies – they are used to saving settings or configurations stored on the User's device between web browser sessions. Examples of such metrics are language version of the Site, location, whether the User has been previously provided with any information or selected benefits, and other Site settings.

(d) Targeted cookies – they are used to provide content that may be of interest to the User. This data is stored on the User's device between web browser sessions. Examples of such data may include, but are not limited to, the following metrics: tracking recommended text, graphics, audio and video content to avoid repetitive display, managing targeted advertising, evaluating the effectiveness of advertising campaigns, information about the User’s visits to other resources during transitions, and other Site settings.

5.5. Some data of cookies files can be provided to the third parties having the permission from the web resource and only for the purposes specified in the Policy. The Organisation can share the data of cookies with advertisers, agencies and partners for the purpose of customization of targeted advertising.


6. Third-party cookies

The Organisation uses services of another third-party service, such as Google Analytics, to deliver, display and analyze content on the Site in a timely manner. This service may use cookies on the User’s device while the Site is in operation. The Organisation has no control over the cookies used by this service. 7. Managing cookies

8. Interaction of the Organisation with third parties


8.1. The Organisation shall not transfer personal data to third parties unless such transfer is required by law at the request of the data subject or in other cases set forth in this Policy. The Organisation understands that personal information is a value and an integral part, including, but not limited to, personal non-property rights of any individual, therefore it takes measures to protect the personal data of Users voluntarily and knowingly transferred by the latter to the Organisation.

8.2. The Site may contain links to other websites (for information purposes only). If you follow a link to other websites, this Policy shall not apply to such websites. Therefore, the Organisation recommends you review the privacy and personal data policies of each website before submitting any personal data allowing to identify you.


9. Personal data protection

9.1. The Organisation uses generally accepted standards of technological and operational protection of data from loss, misuse, changing or destruction of personal data. However, despite best efforts, the Organisation can not guarantee security against any threats arising outside of the Organisation's control.

9.2. The Organisation ensures that all relevant confidentiality obligations as well as technical and organisational security measures are applied to prevent unauthorised or unlawful disclosure or processing of personal data, its accidental loss, destruction, or damage.


10. Terms of personal data access


10.1. The User has the right to receive any information about themselves from the Organisation, if they specify name, surname and patronymic, place of residence (place of stay) and details of the document certifying the individual submitting the request, except for cases established by the laws of Ukraine.

10.2. In accordance with the laws of Ukraine, the Organisation is obliged to verify that any request submitted was sent by a person with a legal right to access data. Before providing any information according to the request for access to such data, the Organisation may ask you to provide additional information to confirm your person and/or legal authority.

10.3. User access to data about themselves is free of charge.

10.4. To update, access, modify, block or delete your personal data, withdraw your consent to the processing of personal data you have provided to the Organisation in accordance with this Policy, or in case of any comments, wishes or complaints about your personal data processed by the Organisation, please contact the Organisation at: [email protected] or 9 (let. 10.5. The Organisation will consider a request and approve it or provide a reasonable refusal to approve such request within 10 (ten) business days from the date the request was received.


11. Data subject rights

The Organisation informs you about your rights as a data subject regulated by the Law of Ukraine "On Personal Data Protection", namely:

(a) to know about the sources of collection, location of personal data, purpose of their processing, location or place of residence (stay) of the personal data owner or processor, or give an appropriate order to receive this information to persons you authorised, except in cases established by law;

(b) to receive information about the conditions for granting access to personal data, in particular information about third parties to whom his personal data is transferred;

(c) to access personal data;

(d) not later than 30 (thirty) calendar days from the date of request receipt, except in cases provided for by law, receive a response on whether personal data is being processed, as well as receive the content of such personal data;

(e) to submit a reasoned request to the personal data owner or with an objection to the processing of personal data;

(f) to submit a reasoned request for modification or destruction of personal data by any personal data owner and processor, if this data is processed illegally or is unreliable;

(g) to protect personal data from illegal processing and accidental loss, destruction, damage due to deliberate concealment, failure to provide data or its untimely provision, as well as protect against providing information that is unreliable or discredits the individual's honour, dignity and business reputation;

(h) to file complaints about the personal data processing with the Ukrainian Parliament Commissioner for Human Rights or with the court;

(i) to apply legal remedies in case of violation of the personal data protection law;

(j) to make reservations regarding the restriction of the right to process personal data when providing consent;

(k) to withdraw consent to the personal data processing;

(l) to know the mechanism of automatic personal data processing;

(m) to be protected from an automated decision-making that has legal consequences.


12. Changes to this Policy


12.1. This Policy can be amended and supplemented from time to time and without prior notice to the User, including, but not limited to, when there are changes to the requirements of the law of Ukraine.

12.2. In case of substantial changes to this Policy, the Organisation will post a notice on the Site indicating the date such changes will take effect. If you do not refuse to accept the updated version of the Policy in writing from the date of posting of such a notice by the Organisation to the date of entry into force of such changes to the Policy, it will mean that you agree to the corresponding changes to the Policy.


13. Miscellaneous

13.1. During the collection and processing of personal data, the Organisation complies with all terms and requirements established by the laws of Ukraine. All issues related to the collection and processing of personal data, not regulated by this Policy, are determined in accordance with the provisions of the laws of Ukraine.
